Smith indicated that Trump indeed broke the law after leaving office. Behar questioned how Trump still occupies his position if he has transgressed the law, prompting co-host Sunny Hostin to remind her of the Department of Justice's longstanding policy against indicting a sitting president. This led Behar to wonder aloud why Trump hasn't followed in Nixon's footsteps and resigned under pressure.

She elaborated on her viewpoint, stating, "The reality is that both the investigations into January 6 and the documents retrieval were constrained by the DOJ's guidelines. However, they were fully aware they had a four-year window to investigate, charge, and prosecute any crimes before the election arrived. From my perspective, it was a disservice to the public that these matters weren’t addressed prior to the election."
Continuing her argument, she emphasized, "Once he secured the presidency, it was essentially too late. Many voices—including mine—were raising concerns about this back when it mattered. I understand the need for a thorough investigation, especially considering the complexities involved, particularly in relation to the January 6 conspiracies, which can indeed take a significant amount of time to unravel. But ultimately, it cast the responsibility onto the public to act as judge, jury, and executioner in this situation."
